Germany ready to roll out pilot trial for recreational cannabis.
An important part of Germany's model for legalizing cannabis for adult use is the introduction of regional pilot trials for the sale of cannabis. The country has leapt forward in implementing pilot trials by announcing that the Federal Office of Agriculture and Food will help oversee the country's research projects on cannabis for adult use, some of which include pilot trials.
"With the adoption of the Consumer Cannabis Act, the Bundestag has entrusted the Federal Ministry of Food and Agriculture (BMEL) with appointing the body responsible for processing research applications on consumer cannabis and industrial hemp. "The regulation now issued, the Regulation on Scientific Consumer Responsibility for Cannabis, obliges the Federal Office of Agriculture and Food to review corresponding research applications and monitor approved projects," a press release from the federal government said.
"Until now, this task was performed by the Federal Institute for Drugs and Health Products (BfArM). "The BfArM remains the competent authority for medical cannabis research," German officials said.
What Cannabis Reform Laws Have Germany Passed so far?
Germany passed the first provisions of the CanG legalization law on April 1, 2024 allowing adults in Germany to grow cannabis in their private residences and possess a personal amount of cannabis both in and outside of their homes.
From July 1, 2024, adults can apply to form a member-based cultivation club in Germany. Home cultivation, possession and consumption in conjunction with cultivation communities were part of "Pillar 1" of the German CanG law.
"Research on and with consumed cannabis is now possible again but requires a permit. Applicants must meet the criteria set out in the Consumer Cannabis Act, demonstrate the required experience and demonstrate a research interest. Not only universities but also companies can submit research proposals. Research can help to effectively stop the black market, expand healthcare and make the debate more objective." While this announcement brings Germany closer to starting pilot trials, more steps are required before final implementation.
"The regulation under Section 2 Paragraph 4 of the KCanG regulates the scientific use of cannabis for consumption. Anyone who wants to possess, cultivate, produce, import, export, acquire, receive, deliver, pass on or trade cannabinoids from the cannabis plant for consumption for scientific purposes needs a permit from the Federal Office for Agriculture and Rural Development." German officials explained on a recently updated FAQ page.
"This is not the "second pillar" of the key points document. The "second pillar" is intended to test cannabis speciality stores across the country through a comprehensive and detailed law. "The Federal Ministry of Health is responsible for drafting this draft law,".
