Decriminalisation Law Approved in Czech Republic

In the Czech Republic, the Chamber of Deputies approved a new law authorising the cultivation of cannabis at home, with a limit of three plants per person. This law also authorizes the possession of 100 grams of cannabis at home and a maximum of 25 grams per person in public.


After several delays, cannabis possession and home cultivation could be decriminalized in the Czech Republic starting in 2026. On Friday, May 30, the Chamber of Deputies approved two amendments to the Criminal Code aimed at raising the criminal threshold for cannabis-related offences.

The amendments are part of the Criminal Code reform bill. The bill was passed by the House with 142 votes and only 13 against. Only the right-wing SPD party opposed the bill.

The objective of these amendments is, in particular, to resolve the prison overcrowding crisis in the Czech Republic.

According to the outgoing Minister of Justice of the Civic Democratic Party, Pavel Blažek, the new law would allow criminal law to better distinguish between behaviour truly harmful to society and that which is not subject to criminal proceedings.

The bill now needs to be voted on by the Senate, where the government has a majority. If adopted without amendment, it should enter into force on January 1, 2026.

What will this mean for the Czech Republic?

From that date, the criminalisation threshold for home cultivation, possession at home, and possession on public roads will be changed for adults over 21 as follows:

It will be legal to cultivate up to three cannabis plants per person.

Cultivating four to five plants will be considered a misdemeanour.

Cultivating more than five plants will be considered a felony.

 

It will be  legal to possess up to 100 grams of cannabis flower.

Possession of 101 to 200 grams is considered a misdemeanour.

Possession of more than 200 grams is a felony.

 

It will be legal to possess up to 25 grams in public.

Possession of 26 to 50 grams is considered a misdemeanour.

Possession of more than 50 grams is a criminal offence.
