A couple who admitted growing drugs in their Chesterfield home have been ordered to pay back more than £33,000.
A couple who admitted growing drugs in their Chesterfield home have been ordered to pay back more than £33,000.
Brian Wilsher, 62, was jailed for three-and-a-half years in April 2013 after pleading guilty to production of cannabis and possession with intent to supply class C drugs.
His wife Marion, also 62, received a 12 month sentence, suspended for two years, after she admitted permitting the production of cannabis at their home on Erin Road, Duckmanton.
The case against the couple began when police carried out a search at their house on July 25th, 2012 and found more than 100 cannabis plants, a large number of diazepam tablets and £7,000 cash.
The pair were arrested and charged with drugs offences and pleaded guilty at a hearing at Derby Crown Court on March 19th, 2013.
At a hearing under the Proceeds of Crime Act (POCA) on Wednesday, June 26th, Brian Wilsher was ordered to pay back £17, 523 and Marion Wilsher was told she must repay £16,102.
The £7,000 recovered during the warrant was forfeited to police.
They have been given six months to meet the order or face 10 months in prison.
The Proceeds of Crime Act means that anyone who profits from crime can lose the financial and lifestyle gains they have enjoyed.
Detective Superintendent Terry Branson, who leads on POCA for the force, said: "The Proceeds of Crime Act is an excellent piece of legislation which allows us to make sure that criminals are stripped of any wealth they have made illegally."
